<\/a><\/span>\u00a0Canada&#8217;s Supreme Court dealt a blow to Prime Minister Justin Trudeau&#8217;s government on Friday by ruling that a federal law assessing how major projects such as coal mines and oil sands plants impact the environment is largely unconstitutional.<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-1\">The decision is a victory for Alberta, Canada&#8217;s main fossil fuel-producing province, which challenged the Impact Assessment Act (IAA), saying it gave Ottawa too much power to kill natural resource projects.<\/p>\n<div class=\"article-body__element__2p5pI\">\n<div class=\"spacing-container__container__2g5QT spacing-container__t-spacing-single-three-quarters__2_moJ spacing-container__b-spacing-single-three-quarters__1fuBK spacing-container__max-width__zScFd\" data-testid=\"ResponsiveAdSlot\">\n<div class=\"ad-slot__container__FEnoz ad-slot__fixed-height__6m70D ad-slot__others__mQ8-F\">\n<div class=\"ad-slot__inner__2u45U ad-slot__others__mQ8-F\">\n<div id=\"reuters_desktop_native_1\" class=\"ad-slot__slot__2lKAK\" data-google-query-id=\"CJDqivnY9YEDFU6yewod0vcFmw\">\n<div id=\"google_ads_iframe_\/4735792\/reuters.com\/world\/americas\/article_1__container__\">\n<div class=\"__fs-ancillary\">\n<div class=\"report-ad-container \">&#8220;This is a significant setback for the federal government,&#8221; said David Wright, a law professor at the University of Calgary.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-3\">&#8220;The court has said the federal government can enact environmental assessment legislation but the way they went about it, for most of this law, goes too far.&#8221;<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-4\">The Supreme Court said the federal government had made the scope of the IAA too broad by including, or designating, projects that would typically fall under provincial jurisdiction.<\/p>\n<div class=\"article-body__element__2p5pI\">\n<div class=\"spacing-container__container__2g5QT spacing-container__t-spacing-single-three-quarters__2_moJ spacing-container__b-spacing-single-three-quarters__1fuBK spacing-container__max-width__zScFd\" data-testid=\"ResponsiveAdSlot\">\n<div class=\"ad-slot__container__FEnoz ad-slot__fixed-height__6m70D\">\n<div class=\"ad-slot__inner__2u45U\">\n<div>&#8220;Parliament has plainly overstepped its constitutional competence in enacting this designated projects scheme,&#8221; Chief Justice Richard Wagner wrote in the 5-2 majority ruling.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-6\">In Canada, natural resource projects mostly fall under provincial jurisdiction, while transport and communications projects that cross provincial boundaries, such as railways or pipelines, are federal.<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-7\">The court said Ottawa can still carry out assessments when projects impact areas of federal authority like fisheries or species at risk.<\/p>\n<div class=\"article-body__element__2p5pI\">\n<div class=\"spacing-container__container__2g5QT spacing-container__t-spacing-single-three-quarters__2_moJ spacing-container__b-spacing-single-three-quarters__1fuBK spacing-container__max-width__zScFd\" data-testid=\"ResponsiveAdSlot\">\n<div class=\"ad-slot__container__FEnoz ad-slot__fixed-height__6m70D\">\n<div class=\"ad-slot__inner__2u45U\">\n<div>The IAA was drafted by Trudeau&#8217;s Liberal government in a bid to streamline and restore trust in the environmental approval process for major projects. It was passed by the Canadian parliament in 2019 and technically remains in place.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-9\">&#8220;We will now take this back and work quickly to improve the legislation through Parliament,&#8221; federal Environment Minister Steven Guilbeault told a news conference.<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-10\">&#8220;Our immediate priority will be to provide guidance to our many stakeholders and Indigenous partners to ensure as much predictability as possible for projects affected.&#8221;<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-11\">The court case is the latest flashpoint between the federal Liberals and Alberta&#8217;s conservative government, whose Premier Danielle Smith has\u00a0clashed repeatedly with Trudeau\u00a0over climate policies.<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-12\">&#8220;Alberta wins! Canada wins!&#8221; Smith wrote on social media.<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-13\">The decision strengthens Alberta&#8217;s efforts to push back against other federal policies, such as a proposed oil and gas emissions cap and clean electricity regulations, Smith said.<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-14\">Industry associations also welcomed the ruling.<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-15\">&#8220;We are delighted with the decision. This is a big win for provincial jurisdiction over development of its own resources,&#8221; said Mike Martens, president of the Independent Contractors and Businesses Association Alberta.<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__small__1kGq2 body__full_width__ekUdw body__small_body__2vQyf article-body__paragraph__2-BtD\" data-testid=\"paragraph-16\">There are currently 23 projects in the federal impact assessment process under the IAA.
